Dr. Arrue Montenegro's practice focuses on international commercial and investment litigation and arbitration under the arbitration rules of the ICC, ICSID, and UNCITRAL, among others. He has been counsel in charge of international arbitration matters at the Panama Canal Authority since 2015 and handled one of the largest construction arbitrations in history. Dr. Arrue Montenegro also acts as an arbitrator. He is a member of the ICSID roster of arbitrators.
He is a professor of international litigation, international commercial law, and private international law at the University of Panama. He has been a visiting professor at conferences organized by universities in Barcelona, ​​Paris, and Rotterdam. He is the author of several publications on international litigation and arbitration, including the book L'autonomie de la volonté dans le conflit de juridictions (LGDJ, 2011, pp. 582).
Representative Experience

- Successful representation of the Republic of Panama in an investment arbitration regarding the alleged violation of the Panama-Dominican Republic BIT concerning the takeover and subsequent liquidation of an insurance company (Leopoldo Castillo Bozo v. Republic of Panama, Case CPA 40-2019).
- Representation of the Republic of Ecuador and PetroEcuador in an ICSID arbitration regarding the alleged violation of the Spain-Ecuador BIT through expropriation of the investment due to tax measures (Repsol YPF Ecuador, S.A., et al. v. Republic of Ecuador and PetroEcuador, ICSID Case No. ARB/08/10).
- Representation of Venezuela in an ICSID arbitration regarding the alleged expropriation of gold and diamond mining concessions (Highbury International AVV and Ramstein Trading Inc. v. Venezuela, ICSID Case No. ARB/11/1).
- Representation of the Panama Canal Authority in a series of complex and multimillion-dollar ICC international arbitrations – previously submitted to the Dispute Adjudication Board (DAB) – related to the expansion of the Panama Canal.
- Representation of an investor in an ICSID arbitration against the Co-operative Republic of Guyana regarding the annulment of a car parking concession contract (Smart City Solutions Holdings Inc. v. Co-operative Republic of Guyana, ICSID Case No. ARB/21/64).
- Representation of a Panamanian company in an ICC arbitration in Paris against a Latin American State and its state entity regarding a construction and operation contract for a power plant.
